Law on inheritance of property in accordance with current law

Property inheritance law is in the Civil Code and related legal documents. This law governs the property relationship between the estate leaver and the heirs.

Inheritance of property is a long-standing social relationship in all regions and localities. Throughout its long history, inheritance has been governed mainly by custom. Today, inheritance has been codified into clear regulations, which are generally applied across the country. The following article will provide readers with the contents of the inheritance institution prescribed by current law (Updated 2022).

What is inheritance?

Inheritance in the common sense is when a person leaves his or her property after death to descendants or family members. In fact, the range of inheritance recipients is not limited to families or people of the same bloodline. It is entirely possible for a person to die leaving property to outsiders or to an agency or organization.

The legal basis of the current inheritance relationship is: the Civil Code and relevant legal documents.

According to current inheritance law, ” inheritance is the transfer of property from the deceased to the heirs” . The heir can be an individual or an organization (according to the will of the deceased). Inheritance is divided into two types: inheritance by will and inheritance by law.

– Inheritance according to a will is an inheritance relationship in which the deceased person disposes of his/her property through a will. Wills must be made before death and must follow the order prescribed by law. The content of the will must be made according to the will of the estate leaver voluntarily, without being deceived, forced, threatened, etc. If violating these conditions, the will may be subject to court action. has the authority to declare invalidity. At that time, the division of the estate will apply in the form of inheritance according to the law.

– Inheritance according to law is applied when the deceased did not leave a will or did leave a will but the will is not legal. The division of the estate is based on the provisions of the law on inheritance.
