Updating and changing the new citizen identification information of the legal representative is a mandatory obligation of businesses. Failure to update or update citizen identification information beyond the deadline may result in the business being handled for administrative violations.

Obligation to update citizen identification information

According to the provisions of the Law on Enterprises, enterprises must carry out procedures for changing business registration when there is a change in the contents of the business registration certificate. Including information about the personal identification papers of the legal representative. Thus, enterprises must change and update new citizen identification information after being issued with a new model citizen identity card.

The time limit for updating and changing information is 10 days from the date of issuance of a new citizen identity card.

In addition, if it is a limited liability company, partnership or private enterprise, the business also needs to update and change citizen identification information for the owner/member of the company/business owner. private.

Clause 1, Article 30 of the Enterprise Law 2020 stipulates:

Article 30. Registration of changes to the enterprise registration certificate

1. An enterprise must register with the business registration authority when changing the contents of its enterprise registration certificate as prescribed in Article 28 of this Law.

2. Enterprises are responsible for registering changes in the contents of the Certificate of Business registration within 10 days from the date of change.

Article 28 of the Enterprise Law 2020 provides:

Article 28. Contents of Certificate of Business Registration

An enterprise registration certificate includes the following principal contents:

1. Enterprise name and enterprise code;

2. Address of the head office of the enterprise;

3. Full name, contact address, nationality, number of legal papers of the individual, for the legal representative of limited liability companies and joint stock companies; for general partners of a partnership company; for business owners of private enterprises. Full name, contact address, nationality, number of legal papers of the individual, for members being an individual; name, enterprise identification number and head office address of the member being an organization, for limited liability companies;

4. Charter capital for companies, investment capital for private enterprises.
